We reserve the right to update or modify these Terms at any time. Your continued use of the Service following notice of changes constitutes acceptance. If you do not agree to any changes, you must stop using the Service.

Eligibility

You must be at least 13 years of age (or the minimum digital age in your jurisdiction, whichever is higher) to use the Service. If you are between 13 and 17 years old, you may only use the Service with verifiable parental or legal guardian consent.

By using the Service, you represent and warrant that: (a) you meet the minimum age requirement; (b) you have not previously been banned from the Service; (c) you are not prohibited from using the Service under any applicable law.

Account Registration

To access most features, you must create an account by providing accurate, current, and complete information. You agree to:

  • Provide truthful and accurate information during registration and keep it up to date
  • Choose a username and password that do not violate anyone's rights
  • Keep your login credentials confidential and not share your account
  • Notify us immediately of any unauthorised use of your account at support@FlexGoo.com
  • Accept responsibility for all activities that occur under your account

Account Verification

Certain activities — such as hosting paid events, processing payouts, or accessing wallet features — may require identity verification (KYC). You must provide accurate identity documents when requested. Failure to verify your identity may restrict access to certain features.

One Account per Person

Each person may maintain only one personal account. Operating multiple accounts or impersonating another person is prohibited and grounds for immediate suspension.

04

User Conduct & Community Standards

FlexGoo is a community platform. You are responsible for all content you post and all actions you take on the Service. You agree to use the Service in a respectful and lawful manner.

You Agree to

  • Comply with all applicable local, national, and international laws and regulations
  • Respect other users and engage in good-faith interactions
  • Use the Service only for its intended personal or commercial purposes
  • Report abusive, illegal, or harmful content using our in-app reporting tools
  • Provide accurate event information if you are an organiser

Prohibited Conduct

You must not, and agree not to:

  • Post, upload, or distribute content that is illegal, obscene, defamatory, harassing, hateful, threatening, or violates any person's rights
  • Impersonate any person, organisation, or FlexGoo staff
  • Create false or misleading events, descriptions, or ticket listings
  • Collect or harvest other users' data without consent
  • Send spam, unsolicited messages, or automated communications
  • Use bots, scrapers, or automated tools to access the Service without permission
  • Attempt to gain unauthorised access to the Service, servers, or other accounts
  • Interfere with or disrupt the Service's infrastructure or other users' enjoyment
  • Engage in ticket fraud, scalping beyond our permitted limits, or resale in violation of organiser policies
  • Use the Service for money laundering, fraud, or any illegal financial activity
  • Post child sexual abuse material or any content that exploits or harms minors
  • Violate any third party's intellectual property rights
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to promote violence, terrorism, or extremist ideologies
🚫
Zero tolerance Certain violations — including posting child exploitation material, threats of violence, fraud, or hacking — will result in immediate permanent account termination and may be reported to law enforcement.

Content Moderation

We reserve the right, but not the obligation, to review, edit, remove, or refuse any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We are not liable for any content posted by users.

05

User-Generated Content & License Grant

Ownership

You retain ownership of all content you create and post on FlexGoo, including photos, videos, reels, event descriptions, and text ("User Content"). We do not claim ownership of your content.

License Grant to FlexGoo

By posting User Content on the Service, you grant FlexGoo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content in connection with operating and promoting the Service.

This license includes the right to display your content to other users, feature it in promotional materials (with attribution where practical), and distribute it through partner channels. You may revoke this license by deleting your content from the Service; however, content that has already been shared or distributed by others may persist.

Your Representations

By posting User Content, you represent and warrant that:

  • You own or have the necessary rights and permissions to post the content
  • Your content does not infringe any third party's intellectual property rights
  • Your content does not violate any person's privacy, publicity, or moral rights
  • Your content complies with these Terms and applicable law
  • You have obtained all necessary consents from individuals appearing in your content

License Grant from FlexGoo to You

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use (or, for creators and organisers, for your permitted commercial activities on the platform).

06

Events, Tickets & Organiser Responsibilities

For Event Attendees

  • Tickets are personal to the purchaser unless explicitly marked as transferable by the organiser
  • Tickets must be presented at the event entrance for validation — keep your QR code accessible
  • Fraudulent, duplicated, or altered tickets are void and not honoured
  • Entry to an event is subject to the organiser's venue policies, not solely FlexGoo's
  • FlexGoo is not responsible for an event being cancelled, postponed, or materially changed by the organiser

For Event Organisers / Creators

  • You are solely responsible for the accuracy of event listings, including date, time, location, and ticket pricing
  • You must honour tickets sold through the platform and provide the event as described
  • In the event of cancellation, you must promptly notify attendees and process eligible refunds in accordance with your stated policy and applicable law
  • You must comply with all applicable laws for the events you host, including age restrictions, licensing, venue capacity, and safety requirements
  • You may not list events that are fraudulent, illegal, or designed to deceive attendees
  • Platform fees and organiser revenue splits are governed by the Creator Agreement you accepted upon applying to host events
  • Identity verification (KYC) is required before payouts are processed

Cancellations & Refunds

Refund eligibility depends on the organiser's stated refund policy for each event. FlexGoo service fees (where applicable) are generally non-refundable unless an event is cancelled by the organiser. If an event is cancelled and no refund is offered by the organiser, you may escalate the dispute to us at support@FlexGoo.com. We will act as a neutral intermediary but do not guarantee refunds from third-party organisers.

07

Wallet, Payments & Refunds

Payment Processing

All payments on FlexGoo are processed by Stripe, a third-party payment processor. By making a payment, you agree to Stripe's Privacy Policy and Services Agreement. We do not store your raw payment card details on our servers.

In-App Wallet

FlexGoo may offer an in-app wallet or credit balance feature. Wallet funds:

  • May be used to purchase tickets and other in-app purchases
  • Are non-transferable between accounts
  • Are not redeemable for cash unless required by applicable law
  • May expire as disclosed at the time of purchase
  • Are subject to AML (Anti-Money Laundering) checks where required

Organiser Payouts

Event organisers are paid net of platform fees and applicable payment processing charges, on a schedule disclosed in the Creator Agreement. Payouts require a verified identity and valid bank account or supported payout method. We reserve the right to withhold payouts pending investigation of fraud, disputed transactions, or policy violations.

Chargebacks & Disputes

If you initiate a chargeback through your bank or card issuer, we reserve the right to suspend your account pending resolution. Abusive chargebacks (where the original charge was valid and authorised) may result in permanent account suspension and referral for debt recovery.

Currency & Taxes

All prices are displayed in the currency specified on the platform. You are responsible for any applicable taxes (including VAT/GST) on your purchases. Organisers are responsible for their own tax obligations related to event revenue.

08

Intellectual Property

FlexGoo's Intellectual Property

The Service — including its design, code, text, graphics, logos, icons, audio clips, and software (excluding User Content) — is owned by or licensed to FlexGoo and is protected by copyright, trademark, and other intellectual property laws. The FlexGoo name, logo, and associated marks are trademarks of FlexGoo / MyFlexGo.

You are granted a limited license to use the Service as described in these Terms. You must not:

  • Copy, modify, or distribute our source code or proprietary materials without permission
  • Use our trademarks, logos, or branding without prior written consent
  • Create derivative works based on our Service or intellectual property
  • Remove or alter any copyright, trademark, or proprietary notices

Feedback

If you submit ideas, suggestions, or feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that Feedback in any manner without obligation or compensation to you.

09

DMCA / Copyright Policy

FlexGoo respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and applicable copyright laws. If you believe content on the Service infringes your copyright, please send a written notice to:

DMCA Notice — FlexGoo
Email: support@FlexGoo.com

Your notice must include: (1) your contact information; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and its URL; (4) a statement that you have a good faith belief the use is not authorised; (5) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorised agent; (6) your physical or electronic signature.

Upon receiving a valid notice, we will promptly remove or disable access to the alleged infringing content and notify the uploader. Repeat infringers may have their accounts terminated.

If you believe your content was wrongly removed, you may file a counter-notification with the same contact information above.

10

Third-Party Links & Services

The Service may contain links to third-party websites, apps, or services. We do not control, endorse, or assume responsibility for any third-party content, products, services, or privacy practices. You access third-party services at your own risk and subject to their own terms.

Third-party integrations within the Service (such as map providers, social login, and payment processors) are governed by the respective third party's terms and privacy policies. We are not liable for any loss or damage arising from your use of third-party services.

11

Disclaimers of Warranties

⚠️
Important legal notice THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

FlexGoo expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or free of viruses or harmful components
  • Warranties as to the accuracy, reliability, or completeness of any content on the Service
  • Warranties regarding user-generated content posted by third parties
  • Warranties regarding the quality, safety, or legality of events listed by third-party organisers

We do not warrant that any events listed on the platform will occur as described, that organisers are trustworthy, or that ticket transactions will be free from fraud. You bear all risk associated with your use of the Service.

12

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLEXGOO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenues, data, business, or goodwill
  • Cost of substitute goods or services
  • Any damages arising from your reliance on any information obtained through the Service
  • Any damages arising from an event being cancelled, postponed, or not as described
  • Unauthorised access to or alteration of your transmissions or data
  • Any other matter relating to the Service

IN NO EVENT SHALL FLEXGOO'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FLEXGOO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

13

Indemnification

You agree to defend, indemnify, and hold harmless FlexGoo and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms or any applicable law or regulation
  • Your User Content — including any claim that your content infringes a third party's rights
  • Your use or misuse of the Service
  • Your conduct in connection with an event (whether as organiser or attendee)
  • Any fraudulent, negligent, or wilful act on your part
  • Any claim by a third party arising from your actions on the platform

We reserve the right, at your expense, to assume control of the defence of any matter subject to indemnification by you, in which case you agree to cooperate with our defence.

14

Dispute Resolution & Arbitration

Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at support@FlexGoo.com and attempt to resolve the dispute informally. We will make a good-faith effort to resolve the matter within 30 days.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising from or related to these Terms or the Service shall be resolved by binding individual arbitration rather than in court, except as set forth below. You waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

Arbitration shall be conducted under the rules of a recognised arbitration body in the applicable jurisdiction, and shall take place in the jurisdiction of FlexGoo's primary place of business unless otherwise agreed.

Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for claims involving: intellectual property infringement, unauthorised access to the Service, or violations that cause immediate irreparable harm.

Class Action Waiver

YOU AND FLEXGOO AGREE THAT EACH MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If this provision is found unenforceable, the entire arbitration section shall be void.

15

Governing Law & Jurisdiction

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the jurisdiction in which FlexGoo is primarily operated, without regard to its conflict of laws provisions.

Subject to the arbitration clause above, each party submits to the exclusive jurisdiction of the courts in the applicable jurisdiction for any legal proceedings.

If you are accessing the Service from the European Union, United Kingdom, or other jurisdictions with mandatory consumer protection laws, nothing in these Terms will deprive you of the protections afforded by those laws.

16

Termination & Account Suspension

Termination by You

You may deactivate or delete your account at any time via the app Settings → Account → Delete Account, or by contacting us at support@FlexGoo.com. Upon deletion, your profile and content will be removed as described in our Privacy Policy. Any pending transactions, outstanding ticket obligations, or payouts will be processed in accordance with applicable policies.

Termination or Suspension by FlexGoo

We may suspend, restrict, or permanently terminate your account at any time, with or without notice, if we believe:

  • You have violated these Terms or our community standards
  • Your account is being used for fraudulent or illegal activity
  • Your account poses a risk to the safety of other users or the platform
  • We are required to do so by law or court order
  • You have failed to complete required identity verification

Effect of Termination

Upon termination, your license to use the Service ceases immediately. Sections of these Terms that by their nature should survive (including disclaimers, limitation of liability, indemnity, and dispute resolution) shall continue to apply after termination.

Appeals

If you believe your account was suspended or terminated in error, you may appeal by contacting us at support@FlexGoo.com with the subject line "Account Appeal." We will review your case but our decision is final.

17

Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will:

  • Update the "Effective Date" and "Last Updated" date at the top of this page
  • Send you an in-app notification or email where required by law or where changes are significant
  • Provide a reasonable notice period before material changes take effect

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.

18
